As municipal governments across the United States increasingly incorporate artificial intelligence into their day-to-day operations to boost efficiency and streamline services, the regulatory frameworks designed to govern these powerful technologies are struggling to keep pace. This growing gap between technological adoption and effective oversight has become a central focus for municipal watchdogs, particularly in the nation’s largest city.

A comprehensive look at how urban centers manage automated systems highlights a persistent challenge for local leaders: ensuring that innovation does not outstrip public trust, accountability, and safety. Nowhere is this tension more evident than in New York City, where a series of state and municipal reviews have shed light on fragmented oversight, inconsistent reporting practices, and a fundamental struggle to define what constitutes artificial intelligence within government agencies.

The scope of the issue came into sharper focus following a 2023 state audit examining the deployment of artificial intelligence systems across New York City agencies between 2019 and 2022. The investigation revealed a wide array of disparate approaches adopted by different municipal entities, with little uniformity in how automated tools were chosen, deployed, or monitored.

According to findings from the comptroller’s office, while individual agencies were occasionally mandated to report certain types of artificial intelligence use on an annual basis, there were virtually no binding rules or standardized guidance governing the actual use of the technology. This absence of centralized direction meant that agencies operated in relative isolation, creating a patchwork of digital implementations with varying levels of security, transparency, and public accountability.

In the wake of these initial findings, oversight of the city’s technological footprint went through several structural iterations. These efforts ultimately culminated in 2022 with the establishment of the New York City Office of Technology and Innovation, known as OTI. Tasked with centralizing technology policy and addressing the vulnerabilities exposed by the initial state audit, the newly formed office published a formal artificial intelligence action plan aimed at bringing order to the city’s digital landscape.

However, a subsequent follow-up audit revealed that meaningful reform has been slow to materialize. As of April, the Office of Technology and Innovation’s proposed artificial intelligence risk-assessment process remains firmly in the development stage, leaving city agencies without a finalized, operational framework to evaluate the potential harms of the tools they deploy. Furthermore, the follow-up audit found that city agencies continue to fall short in clearly and consistently reporting their use of artificial intelligence tools either to the central oversight office or to the general public.

Compounding these structural delays is an ongoing disagreement regarding basic terminology. The lack of a clear, standardized consensus concerning the definition of artificial intelligence persists across municipal government, making it difficult to track exactly which systems are in use, how they function, and what level of scrutiny they require. When different agencies define automated decision-making, machine learning, and algorithmic tools in disparate ways, comprehensive tracking and governance become nearly impossible.

The implications of these regulatory delays extend far beyond bureaucratic inefficiency. Municipal watchdogs and policy experts have repeatedly emphasized that while artificial intelligence holds immense potential to transform public administration, the absence of robust controls creates severe vulnerabilities for the communities these systems are meant to serve.

Reflecting on the broader stakes of digital governance, the comptroller’s office issued a stark assessment of the current trajectory. Although artificial intelligence can enable entities to operate more intelligently, more productively, and more competitively, it is also giving rise to a host of unwanted, and sometimes serious, consequences. Without adequate governance and oversight over the use of artificial intelligence, misguided, outdated, or inaccurate outcomes can occur, potentially leading to unfair or ineffective outcomes for the millions of residents, workers, and visitors who rely on city services every day.
